Supplemental Terms

These supplemental terms (“Supplemental Materials”) to any agreement executed between Serious Name Co. LLC dba Crumb Bouncer (“Crumb Bouncer”) and a third party, entity, or person, using a service provided by or on behalf of Crumb Bouncer (“User”) by which Crumb Bouncer’s Services are provided to User, are provided for transparency and convenience.

All Users of Crumb Bouncer’s Services are subject to these Supplemental Terms. Crumb Bouncer operates under enterprise-level, API licenses, or otherwise paid agreements with third-party providers that provide certain Third-Party Materials, some of which include the use of AI Technologies, which also include explicit no-training protections.

Below is a list of AI Technologies which Crumb Bouncer may make available through its Services, or otherwise uses to support its Services, and information related thereto. User acknowledges it may be subject to these policies and terms and conditions linked hereto or referenced therein in using such Third-Party Materials as part of the Services. Capitalized terms used herein but not defined shall have the meanings set forth in the applicable agreement between Crumb Bouncer and any User.

When using any Third-Party Materials that provide any AI Technologies via the Services, the following terms apply to all Users. By use of or access to the Services, Users agree to the following:

  1. It is any User’s responsibility to ensure that any Outputs generated are appropriate for the intended use case. This is not the responsibility of Crumb Bouncer or any provider of Third-Party Materials, nor shall Crumb Bouncer or any third-party provider of Third-Party Materials be liable for such Outputs.
  2. All Users hereby agree to abide and be bound by the use policies linked above or incorporated in any such links above when using any AI Technology providers as part of the Services.
  3. All Users hereby agree to any use restrictions set forth in any policies of Third-Party Materials providers directed at any customer or user therein. Such use restrictions may include but are not limited to using any Third-Party Materials to:
  4. engage in dangerous or illegal or fraudulent activities, or otherwise violate applicable law or regulations, including but not limited to, using the Services to grow, harvest, farm, share, distribute, or sell any illegal substances;
  5. compromise the security of others or any provider of Third-Party Materials;
  6. engage in sexually explicit, abusive, predatory, violent, hateful, or harmful activities;
  7. impair the safety, wellbeing, or rights of others;
  8. engage in misinformation, misrepresentation, or misleading activities;
  9. develop a similar or competing product or service, circumvent or otherwise improve or create derivative works of any Third-Party Materials;
  10. reverse engineer or extract any components of Third-Party Materials;
  11. threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm;
  12. violate the security, integrity, or availability of any user, network, computer or communications system, software application, or network or computing device;
  13. distribute, publish, send, or facilitate the sending of unsolicited mass email or other messages, promotions, advertising, or solicitations (or “spam”);
  14. operate any hazardous environments or critical systems that may lead to serious bodily injury or death or cause environmental or property damage;
  15. create or facilitate the exchange of illegal or highly regulated weapons or goods;
  16. create psychologically or emotionally harmful content;
  17. spread misinformation;
  18. create political campaigns or interfere in elections;
  19. use for criminal justice, law enforcement, censorship or surveillance purposes;
  20. use any outputs to:
  21. scrape, build databases, or otherwise create permanent copies of such content, or keep cached copies longer than permitted by the cache header;
  22. copy, translate, modify, create a derivative work of, sell, lease, lend, convey, distribute, publicly display, or sublicense to any third party;
  23. misrepresent the source or ownership thereof; or
  24. remove, obscure, or alter any copyright, trademark, or other proprietary rights notices; or
  25. falsify or delete any author attributions, legal notices, or other labels of the origin or source of material.
  26. use the Services in a way that violates applicable laws or policies of AI Technology providers;
  27. use the Services in a way that violates third parties' rights;
  28. allow minors to use the Services;
  29. buy, sell, or transfer API keys if any User ever has any access thereto;
  30. interfere with or disrupt the Services, including, without limitation, circumventing rate limits or safety mitigations existing within the Services;
  31. use the Services to create, receive, maintain, transmit, or otherwise process Protected Health Information;
  32. If using any Third-Party Materials when using our Services to provide advice, recommendations, or subjective decisions that directly impact individuals in high-risk domains, such as providing any professional advice or guidance that may impact any individual, Users are responsible for ensuring a qualified professional in that field is reviewing the content or decision prior to dissemination or finalization. Users acknowledge that they will disclose to all affected individuals that these Third-Party Materials may be used to help inform such decisions or recommendations.
  33. All Users acknowledge that if any accuracy percentage or similar measure is provided with any identifier under the Service, such accuracy measurement is not provided with absolute certainty and should not be interpreted or acted upon as such.
  34. All Users acknowledge they are responsible for all acts and omissions of Users when using the Services.
  35. All Users acknowledge that any Output generated from the Services should not be relied upon without independently checking their accuracy and appropriateness, as such outputs may be false, incomplete, misleading or not reflective of recent events of information. Such outputs are not designed for or intended to meet User’s regulatory, legal, or other obligations, and may contain content inconsistent with Crumb Bouncer’s views.
  36. Users may not access or use the Services in countries where such use is prohibited under U.S. laws or other applicable international law, including to persons, entities, or countries covered by U.S. sanctions.
  37. All Users acknowledge that due to the nature of machine learning, any output may not be unique across Users and the Services may generate the same or similar results across the User base.
  38. All Users agree to any use restrictions of AI Technologies set forth in any terms of Third-Party Material providers.
  39. All Users acknowledge that their data may be used, stored, and processed by Third-Party Material providers described herein for various purposes and that Crumb Bouncer is not responsible for such use.
  40. All Users acknowledge the Third-Party Materials, including any AI Technologies, are provided on an “as is” basis and may be modified, updated, or enhanced from time to time. Crumb Bouncer nor its third-party service providers do not convey any representations or warranties to Users regarding the accuracy, reliability, or completeness of the Third-Party Materials or their suitability for any User’s specific requirements or use case.
  41. All Users acknowledge that Third-Party Materials may include experimental technology and may sometimes provide inaccurate or offensive content that doesn't represent Crumb Bouncer’s views. Users must use their discretion before relying on, publishing, or otherwise using content provided by the Services, and must not rely on the Services for medical, legal, financial, or other professional advice. Any content regarding those topics is provided for informational purposes only and is not a substitute for advice from a qualified professional, and such content does not constitute medical treatment or diagnosis.
  42. All Users acknowledge that these Supplemental Terms may be updated from time to time at Crumb Bouncer’s sole discretion. If changes occur, Crumb Bouncer will notify Users in writing in accordance with the terms of its Terms of Service. Updated versions will never apply retroactively and will give the date they go into effect. User acknowledges that continued use of the Services following the notification of any changes to these Supplemental Terms means the User’s acceptance of such terms.
